Acceptance of Terms
These provisions set out the terms and conditions on which you may make use of the Sugar & Truffle Bakery website (the “Site”) whether as a guest or registered user (“Customer Terms”). We may update these Customer Terms (and the documents referred to in them) and any aspect of the Service from time to time and will notify such changes to you by uploading details of them on the Site. You should review the Customer Terms periodically for changes. By using the Site, you agree to be bound by these Customer Terms. If you do not agree to these Customer Terms then please do not use the Services or any part of them.
1. About us
The Services are operated by Sugar & Truffle Bakery (“we”). We are registered in Texas and our mailing address at 1910 Pacific Ave Ste 16800 #226, Dallas, TX 75201
Accessing our Service
Access to the Services is permitted on a temporary basis, and we reserve the right to withdraw or amend the services we provide through the Site without notice. We will not be liable if for any reason any of the Services are unavailable at any time or for any period.
2. Disclaimer of Warranties and limitation of liability
(a) To the fullest extent permitted by applicable laws, we disclaim responsibility for any harm resulting from your use of any part of the Service.
(b) The Site are provided “as is” and “as available” and we expressly disclaim to the fullest extent permitted by law all express, implied and statutory warranties.
(c) You can use the website at your own discretion and risk, and you are solely responsible for any damages to your hardware device(s) or loss of data that results from the download or use of the App.
(d) Neither we, nor our licensors are liable to you or any user for any use. Such limitation:
(a) Includes direct damages, whether such claim is based on warranty, contract, tort or otherwise (even if we have been advised of the possibility of such damages);
(b) Includes indirect, incidental, consequential, special, exemplary and punitive damages, whether such claim is based on warranty, contract, tort or otherwise (even if we have been advised of the possibility of such damages);
(c) Applies whether damages arise from use or misuse of and reliance on this website, from inability to use the website, or from the interruption, suspension or termination of the website (including any damages incurred by third parties).
(e) Nothing in these Customer Terms shall limit or exclude our liability for fraudulent misrepresentation, for death or personal injury resulting from our negligence or the negligence of our agents or employees or for any other liability that cannot be limited or excluded by law.
3. How contracts are formed between you and Sellers (Our Licensed Franchisees)
Each order you place shall be deemed to be an offer by you to purchase the goods and/or services specified within it subject to the Customer Terms and the applicable details on the product page.
No order shall be deemed to be accepted by the Seller until we (acting as the commercial agent of the Seller) issue an email acknowledgement of order. The contract between you and a Seller will relate only to those goods and/or services notified in the email acknowledgement of order.
4. Payment methods
Purchases for goods and/or services you make with Sellers may be paid for using a debit or credit card, Cash App, Zelle, Apple Pay or cash through our payment facility (or any other payment method which we may make available from time to time). In accepting or otherwise processing your payments related to the purchase of items from sellers, we act in the capacity as commercial agent of the Seller. The Seller acknowledges and agrees that the valid payment by you to us for the purchase of item(s) between you and the Seller will satisfy your obligation to pay the Seller for the relevant item(s) and consequently, any debt obligations owed by you to the Seller for the purchase of such items shall be extinguished at that time. The Seller further agrees that it will not seek recourse (legal or otherwise) against you for payment of items if you have validly paid us. All prices shall be shown in the applicable currency and payable in that currency. You accept that some banks may charge you an additional fee for certain transactions (for example, international transactions). You accept that item prices in the currencies displayed do not vary according to your location.
5. Refusal of transaction
We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of so refusing or by reason of unwinding or suspending any transaction after processing has begun.
6. Returns / Cancellations
If you wish to discuss or organize a return or refund of any non-cancellable item purchased through the Site (see below for a description of non-cancellable items), please contact the store directly in accordance with our Returns & Refunds Policy. Any returns or refunds shall be made by the store in accordance with the Returns & Refunds Policy set out in the Services Standards.
Baked treats made to order must be collected as arranged. Preparation for orders can start as early as 24 hours before collection. Therefore, if you try to cancel your order within 1 BUSINESS DAY of the collection time, it is highly unlikely that We will be able to cancel your order (depending upon the order, alterations may be available if applicable.
No refunds will be given for:
cancellations within 24 hours of collection time.
uncollected baked treats- for whatever reason.
Uncollected baked treats will be sold 24 hours after the collection time has lapsed.
Due to current cottage food laws, we’re unable to offer shipping at this time. But don’t worry—we’re working behind the scenes to bring exciting changes your way!
As our product is perishable, baked and decorated, our refund/exchange policy is as follows:
If there is a defect in your product please return it promptly, or the portion remaining, within 2 days of pick up. In this case we will provide you a proportionate refund for the amount returned if we determine there is a quality deficiency. We retain the right to judge our product quality for ourselves. If you try one of our products and are dissatisfied, then we hope you try something different next time; however, a refund will not be given.
Cancellations and/or changes for decorated treats must be made at least 1 business day in advance of the scheduled pick up time.
If you do not pick up your order, we do not give a refund. If you need it at a later date, you will have to pay for both the original and the reorder. We will resell any product that is not picked up by the customer as we are a home bakery with limited space.
Refunds, if accepted, are sent to the credit/debit card used in the initial order. No cash refunds. The card used for the purchase will receive reimbursement. Sugar & Truffle Bakery holds the right to withhold partial funds to cover transaction processing fees. Refund requests must be made by the payor/buyer through email or over the phone. No other contact forms will be accepted.
Sugar & Truffle Bakery reserves the right to modify its exchange/return policy at any time
Should an order be delivered and it appears damaged upon arrival it is the responsibility of the customer to take a photo and contact the bakery at latest 10 minutes of taking possession of the order. Delays in attempting to contact the bakery are considered in eligible for reimbursement. Should you receive the order and it is incorrect the customer must take a photo and contact the bakery at latest 10 minutes of taking possession of the order.
Unfortunately, we can’t offer exchange on all baked goods. All baked good sales are final.

Privacy Policy
1) This privacy policy applies to Sugar & Truffle Bakery's website at www.sugarandtrufflebakery.com (the “Website”). We at the Sugar & Truffle Bakery take your privacy seriously. This policy covers the collection, processing and other use of personal data under the Data Protection Act 1998 (“DPA”) and the General Data Protection Regulations (“GDPR”).

4) We will collect personal data on this Website only if it is directly provided to us by you the user, e.g. your e-mail address, name, home or work address, and telephone number, and therefore has been provided by you with your consent.
5) We also use analytical and statistical tools that monitor details of your visits to our website and the resources that you access, including, but not limited to, traffic data, location data, weblogs and other communication data (but this data will not identify you personally).
6) Your payment information (e.g. credit card details) provided when you make a purchase from our website is not received or stored by us. That information is processed securely and privately by the third party payment processors that we use. Sugar & Truffle Bakery will not have access to that information at any time. We may share your personal data with our payment processors, but only for the purpose of completing the relevant payment transaction. Such payment processors are banned from using your personal data, except to provide these necessary payment services to us, and they are required to maintain the confidentiality of your personal data and payment information.

7) We may hold and process personal data that you provide to us in accordance with the DPA and GDPR.
8) The information that we collect and store relating to you is primarily used to enable us to provide our services to you, and to meet our contractual commitments to you. In addition, we may use the information for the following purposes:
8.1 To notify you about any changes to our website, such as improvements or service/product changes, that may affect our service;
8.2 If you are an existing customer, we may contact you with information about goods and services similar to those that were the subject of a previous sale to you;

9) We may disclose your information to regulatory bodies to enable us to comply with the law and to assist fraud protection and minimize credit risk.
10) Please be advised that we do not reveal information about identifiable individuals to our advertisers but we may, on occasion, provide them with aggregate statistical information about our visitors.

11) If you have given us consent to use your data for a particular purpose you can revoke or vary that consent at any time. 12) We do not use or disclose sensitive personal data, such as race, religion, or political affiliations, without your explicit consent.
13) We may disclose your personal data outside of our group: (a) in the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets; and (b) if the Sugar & Truffle Bakery’s business is bought by a third party, in which case personal data held by it about its customers will be one of the assets to transfer to the buyer. However, any such transfer will only be on terms that the confidentiality of your personal data is protected and that the terms of this privacy policy will continue to be complied with by the recipient.

Although we will do our best to protect your personal data, we cannot guarantee the security of data while you are transmitting it to our site; any such transmission is at your own risk. Once we have received your personal data, we will use strict procedures and security features to try to prevent unauthorized access.
16) Where we have given you (or where you have chosen) a password so that you can access certain parts of our site, you are responsible for keeping this password confidential. You should choose a password it is not easy for someone to guess.

16) The DPA and GDPR give you the right to access information held about you by us. Please write to us or contact us by email if you wish to request confirmation of what personal information we hold relating to you. There is no charge for requesting that we provide you with details of the personal data that we hold. We will provide this information within one month of your requesting the data.
17) You have the right to change the permissions that you have given us in relation to how we may use your data. You also have the right to request that we cease using your data or that we delete all personal data records that we hold relating to you.
